I need some background information for a legal problem, and I hope someone here can help me. I realize that my question may be very basic for most of you, but I would really appreciate the feedback.

I am dealing with a law that contains the element "when upon any grade exceeding three percent (3%)," with regards to a car parked upon a highway. What is the common meaning of a 3% grade? Is it merely a 3% incline/decline from the horizon? Or is their more to its computation?

A rise of 3 feet over a distance of 100 feet is a positive 3% grade. a fall of 3 feet over 100 feet is a negative 3% grade. (Rise/Run) x 100 = grade expressed in percent
 
The 3%, as already explained, refers to the gradient, or slope, referenced in the excerpt. Now, this gradient can be the grade of the road...it's slope, or it's cross sectional grade (the slope from the centreline to the shoulder) and would be defined within the context of the law itself.
